and<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0doing all acts and things as bodies corporate may lawfully do.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"&quot;&lt;p\"><\/a>{mprestriction ids=&#8221;1,2,3&#8243;}<\/p>\n<p>Ch208s3&#8243;&gt;3.\u00a0\u00a0\u00a0Composition of the commission.<\/p>\n<p>\u00a0\u00a0\u00a0The commission shall consist of the following members\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0the chairperson, who shall be appointed by the President;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0the Minister responsible for health, who shall be the vice chairperson;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0not more than 21 other members appointed by the President;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>d<\/i>)\u00a0\u00a0\u00a0the director general of the Uganda AIDS Commission secretariat, who shall be the secretary to the commission, and who shall be appointed by the President on such terms and conditions as the President may determine.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Ch208s4\"><\/a>4.\u00a0\u00a0\u00a0The secretariat.<\/p>\n<p>\u00a0\u00a0\u00a0(1) The commission shall be serviced by a secretariat consisting of\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0the director general who shall be the chief executive and accounting officer of the commission;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0such other technical staff as may be appointed by the commission; and<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0such support staff as may be appointed by the director general and approved by the commission.<\/p>\n<p>\u00a0\u00a0\u00a0(2) The staff of the secretariat shall hold office on such terms and conditions as the commission may determine.<\/p>\n<p>\u00a0\u00a0\u00a0(3) The functions of the secretariat shall be\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0to ensure implementation of the decisions and programmes of the commission;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0to advise the Government on all matters relating to the commission&#8217;s objectives under this Act; and<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0to perform such other functions as the commission may direct.<\/p>\n<p>\u00a0\u00a0\u00a0(4) The chairperson of the commission shall be responsible for the supervision of the director general and the secretariat.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Ch208s5\"><\/a>5.\u00a0\u00a0\u00a0Functions and powers of the commission.<\/p>\n<p>\u00a0\u00a0\u00a0(1) The functions of the commission shall be to oversee, plan and coordinate AIDS prevention and control activities throughout Uganda and, in particular, to\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0formulate policy and establish programme priorities for the control of the AIDS epidemic and management of its consequences throughout the country;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0ensure proper planning and coordination of all AIDS control policies and programmes within the overall programme strategy;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0identify obstacles to the implementation of AIDS control policies and programmes and ensure the implementation and attainment of programme activities and targets;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>d<\/i>)\u00a0\u00a0\u00a0mobilise, expedite and monitor resources for the AIDS control programmes and activities;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>e<\/i>)\u00a0\u00a0\u00a0disseminate information on the AIDS epidemic and its consequences in Uganda and on the programme activities for its control;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>f<\/i>)\u00a0\u00a0\u00a0supervise all activities relating to the control of the AIDS epidemic in Uganda and, in particular, regarding\u2014<\/p>\n<p class=\"TRI\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0(i)\u00a0\u00a0\u00a0health care and counselling of AIDS patients;<\/p>\n<p class=\"TRI\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0(ii)\u00a0\u00a0\u00a0the welfare of bereaved orphans and survivors of AIDS victims;<\/p>\n<p class=\"TRI\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0(iii)\u00a0\u00a0\u00a0the provision of medical supplies and equipment;<\/p>\n<p class=\"TRI\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0(iv)\u00a0\u00a0\u00a0the handling of socioeconomic, cultural and legal issues related to the AIDS epidemic; and<\/p>\n<p class=\"TRI\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0(v)\u00a0\u00a0\u00a0biomedical research and surveillance into the AIDS epidemic and methods of its prevention and control;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>g<\/i>)\u00a0\u00a0\u00a0find a drug for the cure of the AIDS disease; and<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>h<\/i>)\u00a0\u00a0\u00a0perform such other functions relating to the prevention or control of the AIDS epidemic in Uganda as the commission may deem necessary.<\/p>\n<p>\u00a0\u00a0\u00a0(2) The commission shall in the performance of its functions under this Act\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0be responsible to the President;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0from time to time submit progress reports on its activities to the President and any other person or body which the commission may deem necessary; and<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0be advised by a committee of technical experts selected by the AIDS control implementors in the various sectors of the national AIDS control programme.<\/p>\n<p>\u00a0\u00a0\u00a0(3) The common seal of the commission shall be authenticated by the signature of the chairperson and the secretary or the secretary and two directors.<\/p>\n<p>\u00a0\u00a0\u00a0(4) A decision or directive of the commission shall be authenticated under the chairperson&#8217;s hand.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Ch208s6\"><\/a>6.\u00a0\u00a0\u00a0Procedure of the commission.<\/p>\n<p>\u00a0\u00a0\u00a0(1) Subject to this section, the commission may regulate its own procedure.<\/p>\n<p>\u00a0\u00a0\u00a0(2) The chairperson of the commission shall preside at all meetings, and in his or her absence the vice chairperson shall preside; and in the absence of both of them, the members present shall elect one of themselves to preside.<\/p>\n<p>\u00a0\u00a0\u00a0(3) The <i>quorum<\/i> of the commission shall be one-third of the members, and every question shall be decided by a majority of the members present and voting.<\/p>\n<p>\u00a0\u00a0\u00a0(4) The commission may co-opt a person to attend any of its meetings in an advisory capacity, but that person shall not be entitled to vote.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Ch208s7\"><\/a>7.\u00a0\u00a0\u00a0Funds of the commission.<\/p>\n<p>\u00a0\u00a0\u00a0(1) The funds of the commission shall consist of such sums as may be provided by\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0Parliament;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0donor support groups; or<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0any other person.<\/p>\n<p>\u00a0\u00a0\u00a0(2) The expenditure of the commission shall be a charge on the Consolidated Fund.<\/p>\n<p>\u00a0\u00a0\u00a0(3) The commission shall be a self-accounting body and shall in its financial matters deal directly with the Ministry responsible for finance.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Ch208s8\"><\/a>8.\u00a0\u00a0\u00a0Accounts and audit.<\/p>\n<p>\u00a0\u00a0\u00a0(1) The commission shall, through its secretariat, keep proper books of account in respect of its income and expenditure, in a form approved by the Auditor General.<\/p>\n<p>\u00a0\u00a0\u00a0(2) The books of account of the commission and other financial records shall be audited by the Auditor General or any other auditors appointed by the Auditor General within three months after the end of each financial year.<\/p>\n<p>\u00a0\u00a0\u00a0(3) The annual financial report of the Auditor General regarding the commission&#8217;s accounts shall be laid before Parliament by the Minister responsible for finance.<\/p>\n<p>\u00a0\u00a0\u00a0(4) Donor support groups may appoint an independent auditor to audit the accounts of the commission.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Ch208s9\"><\/a>9.\u00a0\u00a0\u00a0Regulations.<\/p>\n<p>\u00a0\u00a0\u00a0The chairperson, on the advice of the commission, may make regulations generally for better carrying out the functions of the commission under this Act.<\/p>\n<table class=\"tableborder\" width=\"100%\" cellspacing=\"3\" cellpadding=\"3\">\n<tbody>\n<tr style=\"font-size: 12px\">\n<td class=\"tableborder\" colspan=\"2\">\u00a0<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p class=\"CenteredBold\"><i>History<\/i>\u00a0<\/p>\n<p class=\"Centered\">Legislation<b>\u00a0<\/b><\/p>\n<p class=\"Centered\">Number<b>\u00a0<\/b>Statute<b>\u00a0<\/b>2\/1992<b> {\/mprestriction}<\/b><\/p>\n<hr \/>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0 UGANDA AIDS COMMISSION ACT.
