Minister who dies while in office.<\/p>\n<p>\u00a0<\/p>\n<p class=\"CenteredBold\">EMOLUMENTS AND BENEFITS OF THE PRESIDENT, VICE PRESIDENT AND PRIME MINISTER ACT, 2010.<\/p>\n<p align=\"right\"><i>Commencement<\/i>: 8 October, 2010.<\/p>\n<p>\u00a0\u00a0\u00a0An Act to provide for the salaries, allowances and other benefits of a President, Vice President and Prime Minister in accordance with articles 106, 108 and 108A of the Constitution; to repeal and replace the Presidential Emoluments and Benefits Act, Cap. 263 and for other related matters.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s1\"><\/a>1.\u00a0\u00a0\u00a0Interpretation.<\/p>\n<p>\u00a0\u00a0\u00a0In this Act, unless the context otherwise requires\u2014<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;abuse of office&#8221;<\/b> means doing or directing to be done an arbitrary act prejudicial to the interest of a public body or a company in which the Government has shares or abuse of authority of a persons&#8217; office;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;chauffer driven vehicle&#8221;<\/b> means a four wheel vehicle driven by an official driver;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;child&#8221;<\/b> means a person below the age of 18 years and includes an adopted child;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;currency point&#8221;<\/b> has the value assigned to it in the First Schedule;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;extra judicial killing&#8221;<\/b> means the killing of a human being not in accordance with the law;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;four wheel vehicle&#8221;<\/b> means a vehicle with four axles;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;Minister&#8221;<\/b> means the Minister responsible for public service;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;security guard&#8221;<\/b> means a police officer assigned duties by the Inspector General of Police for purposes of guarding the person and residence of the former President, former Vice President and former Prime Minister as the case may be;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;spouse&#8221;<\/b> means a wife or husband;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;subversive action&#8221;<\/b> means an action or omission that is prejudicial to, or undermines the security of the State;<\/p>\n<p>\u00a0\u00a0\u00a0<b>&#8220;vehicle&#8221;<\/b> means\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0in case of a President, a 4000 to 5000 cc vehicle;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0in case of a Vice President, a 3500 to 4000 cc vehicle; and<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0in case of a Prime Minister, a 3000 to 3500 cc vehicle.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s2\"><\/a>2.\u00a0\u00a0\u00a0Salary, allowances and other benefits of the President.<\/p>\n<p>\u00a0\u00a0\u00a0The President shall be paid the salary and allowances and shall be afforded the other benefits specified in relation to the office of President in the Second Schedule to this Act.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s3\"><\/a>3.\u00a0\u00a0\u00a0Salary, allowances and other benefits of the Vice President.<\/p>\n<p>\u00a0\u00a0\u00a0The Vice President shall be paid the salary and allowances and shall be afforded the other benefits specified in relation to the office of Vice President in the Third Schedule to this Act.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s4\"><\/a>4.\u00a0\u00a0\u00a0Salary, allowances and other benefits of the Prime Minister.<\/p>\n<p>\u00a0\u00a0\u00a0The Prime Minister shall be paid the salary and allowances and shall be afforded the other benefits specified in relation to the office of Prime Minister in the Fourth Schedule to this Act.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s5\"><\/a>5.\u00a0\u00a0\u00a0Benefits for a President ceasing to hold office.<\/p>\n<p>\u00a0\u00a0\u00a0(1) A President who ceases to hold office otherwise than by being removed under article 107(1)(<i>a<\/i>) or (<i>b<\/i>) of the Constitution shall be granted the benefits specified in the Fifth Schedule to this Act.<\/p>\n<p>\u00a0\u00a0\u00a0(2) A President to whom subsection (1) applies shall not qualify for a grant of benefits under that subsection\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0if he or she is convicted for subversive activities against Uganda or another country;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0if he or she is convicted for extra judicial killing;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0if he or she is convicted for a crime involving dishonesty or moral turpitude; or<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>d<\/i>)\u00a0\u00a0\u00a0if he or she is convicted for stealing, money laundering, fraud or any similar unlawful activity.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s6\"><\/a>6.\u00a0\u00a0\u00a0Benefits of surviving spouse or spouses and dependent children of a President who dies in office.<\/p>\n<p>\u00a0\u00a0\u00a0The benefits specified in the Sixth Schedule to this Act shall be enjoyed together by the surviving spouse or spouses and dependent children of a President who dies while in office until the death of the spouse or spouses or in the case of the dependent children, until they attain the age of 18 years or until they die, whichever is the earlier.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s7\"><\/a>7.\u00a0\u00a0\u00a0Benefits of surviving spouse or spouses and dependent children of a deceased retired President.<\/p>\n<p>\u00a0\u00a0\u00a0The benefits specified in the Seventh Schedule to this Act shall be enjoyed together by the surviving spouse or spouses and dependent children of a President who dies in retirement until the death of the spouse or spouses or in the case of the dependent children, until they attain the age of 18 years or until they die whichever is earlier.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s8\"><\/a>8.\u00a0\u00a0\u00a0Benefits for a Vice President ceasing to hold office.<\/p>\n<p>\u00a0\u00a0\u00a0(1) A Vice President who ceases to hold o<\/p>\n<p>{mprestriction ids=&#8221;1,2,3&#8243;}<\/p>\n<p>ffice shall be granted the benefits specified in the Eighth Schedule to this Act.<\/p>\n<p>\u00a0\u00a0\u00a0(2) A Vice President to whom subsection (1) applies shall not qualify for a grant of benefits under that subsection if he or she is removed from office on any of the following grounds\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0abuse of his or her office;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0misconduct or misbehaviour;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0conviction for subversive activities against Uganda or another country;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>d<\/i>)\u00a0\u00a0\u00a0conviction for extra judicial killing;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>e<\/i>)\u00a0\u00a0\u00a0conviction for a crime involving dishonesty or moral turpitude; or<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>f<\/i>)\u00a0\u00a0\u00a0conviction for stealing, money laundering, fraud or any similar unlawful activity.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s9\"><\/a>9.\u00a0\u00a0\u00a0Benefits of surviving spouse or spouses and dependent children of a Vice President who dies in office.<\/p>\n<p>\u00a0\u00a0\u00a0The benefits specified in the Ninth Schedule to this Act, shall be enjoyed together by the surviving spouse or spouses and the dependent children of a Vice President who dies while in office until the death of the spouse or spouses or in the case of the dependent children, until they attain the age of 18 years or until they die whichever is the earlier.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s10\"><\/a>10.\u00a0\u00a0\u00a0Benefits of surviving spouse or spouses of a deceased retired Vice President.<\/p>\n<p>\u00a0\u00a0\u00a0The benefits specified in the Tenth Schedule to this Act, shall be enjoyed together by the surviving spouse or spouses and dependent children of a Vice President who dies in retirement until the death of the spouse or spouses or in the case of the dependent children until they attain the age of 18 years or until they die whichever is the earlier.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s11\"><\/a>11.\u00a0\u00a0\u00a0Benefits for a Prime Minister ceasing to hold office.<\/p>\n<p>\u00a0\u00a0\u00a0(1) A Prime Minister who ceases to hold office shall be granted the benefits specified in the Eleventh Schedule to this Act.<\/p>\n<p>\u00a0\u00a0\u00a0(2) A Prime Minister to whom subsection (1) applies shall not qualify for a grant of benefits if he or she is removed from office on any of the following grounds\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0abuse of his or her office;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0misconduct or misbehaviour;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0conviction for subversive activities against Uganda or another country;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>d<\/i>)\u00a0\u00a0\u00a0conviction for extra judicial killing;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>e<\/i>)\u00a0\u00a0\u00a0conviction for a crime involving dishonesty or moral turpitude; or<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>f<\/i>)\u00a0\u00a0\u00a0conviction for stealing, money laundering, fraud or any similar unlawful activity.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s12\"><\/a>12.\u00a0\u00a0\u00a0Benefits of surviving spouse or spouses and dependent children of a Prime Minister who dies in office.<\/p>\n<p>\u00a0\u00a0\u00a0The benefits specified in the Twelfth Schedule to this Act, shall be enjoyed together by the surviving spouse or spouses and dependent children of a Prime Minister who dies while in office until the death of the spouse or spouses or in the case of the dependent children until they attain the age of 18 years or until they die whichever is the earlier.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s13\"><\/a>13.\u00a0\u00a0\u00a0Benefits of surviving spouse or spouses and dependent children of a deceased retired Prime Minister.<\/p>\n<p>\u00a0\u00a0\u00a0The benefits specified in the Thirteenth Schedule to this Act, shall be enjoyed together by the surviving spouse or spouses and dependent children of a Prime Minister who dies in retirement until the death of the spouse or spouses or in the case of the dependent children, until they attain the age of 18 years or until they die whichever is the earlier.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s14\"><\/a>14.\u00a0\u00a0\u00a0Funeral benefits for a President who dies while in office.<\/p>\n<p>\u00a0\u00a0\u00a0Where a President dies while in office he or she shall be accorded a state funeral and he or she shall be accorded the benefits specified in the Fourteenth Schedule to this Act.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s15\"><\/a>15.\u00a0\u00a0\u00a0Funeral benefits for a Vice President who dies while in office.<\/p>\n<p>\u00a0\u00a0\u00a0Where a Vice President dies while in office he or she shall be accorded a state funeral and he or she shall be accorded the benefits specified in the Fourteenth Schedule to this Act.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s16\"><\/a>16.\u00a0\u00a0\u00a0Funeral benefits for a Prime Minister who dies while in office.<\/p>\n<p>\u00a0\u00a0\u00a0Where a Prime Minister dies while in office he or she is entitled to an official funeral and shall be accorded the benefits specified in the Fourteenth Schedule to this Act.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s17\"><\/a>17.\u00a0\u00a0\u00a0Government&#8217;s contribution towards funeral expenses.<\/p>\n<p>\u00a0\u00a0\u00a0Where a President, Vice President or Prime Minister dies while in office, the Government shall contribute 30 percent of the gross annual salary of the President, Vice President or Prime Minister towards the funeral expenses.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s18\"><\/a>18.\u00a0\u00a0\u00a0Funeral benefits for the spouses.<\/p>\n<p>\u00a0\u00a0\u00a0Where the spouse of a sitting President, Vice President or Prime Minister dies, the Government shall contribute 30 percent of the annual salary of the President, Vice President or Prime Minister whichever the case may be.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s19\"><\/a>19.\u00a0\u00a0\u00a0Vice President acting as President to enjoy benefits of President.<\/p>\n<p>\u00a0\u00a0\u00a0Where a Vice President acts as a President for a period of six months or more, he or she shall be entitled to the salary and allowance of the President for the period he or she acts as a President.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s20\"><\/a>20.\u00a0\u00a0\u00a0Revocation of appointment of Vice President or Prime Minister.<\/p>\n<p>\u00a0\u00a0\u00a0(1) Where the President revokes the appointment of a Vice President or a Prime Minister, the Vice President or Prime Minister shall only enjoy the benefits under this Act upon retirement, even where they have been reassigned other Government duties.<\/p>\n<p>\u00a0\u00a0\u00a0(2) Where the Vice President or Prime Minister, becomes a Member of Parliament, he or she shall benefit from the greater of the benefits, under this Act and those enjoyable by a Member of Parliament but not both.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s21\"><\/a>21.\u00a0\u00a0\u00a0Misconduct after retirement.<\/p>\n<p>\u00a0\u00a0\u00a0Where a retired President, Vice President or Prime Minister is serving a sentence of imprisonment the benefits they are enjoying shall be suspended until they serve their sentence.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s22\"><\/a>22.\u00a0\u00a0\u00a0Ownership of house.<\/p>\n<p>\u00a0\u00a0\u00a0The State shall for the purposes of the Second and Fifth Schedules provide a house of appropriate quality, design and location, the ownership of which shall vest in Government.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s23\"><\/a>23.\u00a0\u00a0\u00a0Payment of benefits on resignation.<\/p>\n<p>\u00a0\u00a0\u00a0For the avoidance of doubt\u2014<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0the benefits specified in Part B of the Fifth Schedule to this Act shall be payable in respect of a President who resigns from office;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0the benefits specified in Part B of the Eighth Schedule to this Act shall be payable in respect of a Vice President who resigns from office;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>c<\/i>)\u00a0\u00a0\u00a0the benefits specified in Part B of the Eleventh Schedule to this Act shall be payable in respect of a Prime Minister who resigns from office;<\/p>\n<p class=\"TI\">\u00a0\u00a0\u00a0(<i>d<\/i>)\u00a0\u00a0\u00a0the benefits payable to a spouse or spouses and dependent children of a deceased retired President, deceased retired Vice President or deceased retired Prime Minister under this Act, shall respectively be payable to the spouse or spouses or dependent children of a deceased President, Vice President or a Prime Minister who ceases to hold office by resignation.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s24\"><\/a>24.\u00a0\u00a0\u00a0Vehicle maintenance.<\/p>\n<p>\u00a0\u00a0\u00a0The vehicles provided for under this Act, shall be procured, fuelled and maintained by the Government.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s25\"><\/a>25.\u00a0\u00a0\u00a0Expenses to be charged on Consolidated Fund.<\/p>\n<p>\u00a0\u00a0\u00a0The salaries, allowances and benefits granted under this Act shall be charged on the Consolidated Fund.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s26\"><\/a>26.\u00a0\u00a0\u00a0Five yearly review.<\/p>\n<p>\u00a0\u00a0\u00a0The salaries, allowances and benefits granted under this Act, shall be reviewed every five years.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s27\"><\/a>27.\u00a0\u00a0\u00a0Disapplication of the Parliament (Remuneration of Members) Act.<\/p>\n<p>\u00a0\u00a0\u00a0(1) The Parliament (Remuneration of Members) Act, shall not apply to any period in respect of which a person is paid or granted any salary, allowances or benefits under this Act.<\/p>\n<p>\u00a0\u00a0\u00a0(2) Nothing in this section shall deprive a person of a right which has accrued to him or her under the Act referred to in subsection (1) in respect of any period before the application of this Act to that person.<\/p>\n<p>\u00a0\u00a0\u00a0(3) Parliament may, by resolution, make such adjustments as may be necessary to accommodate any person who acts temporarily in the office of President, Vice President or Prime Minister to this Act.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s28\"><\/a>28.\u00a0\u00a0\u00a0Amendment of Schedules.<\/p>\n<p>\u00a0\u00a0\u00a0(1) The Minister in consultation with the Minister responsible for finance, shall amend the First Schedule.<\/p>\n<p>\u00a0\u00a0\u00a0(2) Parliament may, by resolution, amend the Second, Third, Fourth, Fifth, Sixth, Seventh, Eighth, Ninth, Tenth, Eleventh, Twelfth, Thirteenth and Fourteenth Schedules to this Act.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s29\"><\/a>29.\u00a0\u00a0\u00a0Application of the Parliament (Remuneration of Members) Act.<\/p>\n<p>\u00a0\u00a0\u00a0For the avoidance of doubt, section 3 of the Parliament (Remuneration of Members) Act shall continue to apply to a President or Vice President who ceased to hold that office before the commencement of the 1995 Constitution.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s30\"><\/a>30.\u00a0\u00a0\u00a0Application of sections 2, 3 and 4.<\/p>\n<p>\u00a0\u00a0\u00a0For the avoidance of doubt, sections 2, 3 and 4 of this Act, as the case may be, apply only to a President, Vice President and Prime Minister under the 1995 Constitution.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s31\"><\/a>31.\u00a0\u00a0\u00a0Benefits to be granted collectively.<\/p>\n<p>\u00a0\u00a0\u00a0For the avoidance of doubt, the benefits of the spouse or spouses of a person who dies while holding the office of President, Vice President and Prime Minister shall be granted to the spouse or spouses collectively for life.<\/p>\n<p class=\"L8\">\u00a0<\/p>\n<p class=\"Level-Iblue\"><a name=\"Act19of2010s32\"><\/a>32.\u00a0\u00a0\u00a0Repeal and transitional provision.<\/p>\n<p>\u00a0\u00a0\u00a0(1) The Presidential Emoluments and Benefits Act is repealed.<\/p>\n<p>\u00a0\u00a0\u00a0(2) Without prejudice to the Interpretation Act, the repeal of the Presidential Emoluments and Benefits Act shall not prejudice any right to which a person was entitled under that Act immediately before the commencement of this Act.<\/p>\n<p class=\"L5\">\u00a0<\/p>\n<p class=\"Level-Centeredblue\"><a name=\"Act19of2010-Sch1\"><\/a><i>First Schedule.<\/i><\/p>\n<p align=\"right\">s. 1<\/p>\n<p class=\"CenteredBold\">Currency point.<\/p>\n<p>\u00a0\u00a0\u00a0A currency point is equal to twenty up to university level, subject to the following limitations\u2014<\/p>\n<hr \/>\n<p class=\"QT-TI\">\u00a0\u00a0\u00a0(<i>a<\/i>)\u00a0\u00a0\u00a0the pre primary, primary and secondary levels of education shall be paid for by the State only when the children study in Uganda in a Government aided school;<\/p>\n<hr \/>\n<p class=\"QT-TI\">\u00a0\u00a0\u00a0(<i>b<\/i>)\u00a0\u00a0\u00a0the State
